Eco 360 Terms, Conditions and Disclaimers (unless otherwise stated)

 

By commissioning Eco 360 to undertake the survey work outlined, you hereby agree to all terms and conditions stated below, unless otherwise agreed in writing.

 

1.1      Service

 

             Eco 360 agrees to supply environmental consulting services and advice of a preliminary or thorough nature as advised or commissioned. Upon commissioning Eco 360 to undertake the work, the client(s) grant access to the site upon the agreed date. If no site access is available upon this date, Eco 360 holds the right to charge the client(s) for lost staffing time and additional travel costs.

 

1.2   Fees

 

By commissioning Eco 360, the client(s) accept to paying a minimum of a 25% deposit upfront to secure a date for the required survey with full payment required before the site visit. Eco 360 will not attend site until full payment has been received from the client.

 

The client(s) will settle the agreed fee in full within 15 days of receiving the invoice. All reports and/or documentation will remain the property of Eco 360 until full payment has been received. No liability is accepted for the contents of a report that is not paid in full. Any queries should be notified to Eco 360 within 10 working days of the invoice date.

 

             Eco 360 charge Value Added Tax (V.A.T) on all services provided at 20%. Eco 360 withholds the right to add costs to the quoted price, should the Ecological Data Search supplied from the local record centre cost more than that anticipated within the quote. Eco 360 do not charge any excess on this search.

 

             If the client(s) fails to pay within the time specified above, then Eco 360 shall charge the client(s) interest on the outstanding fee, both before and after any judgment, at the rate of 5% per month above the HSBC Bank base rate, until payment is made in full (with a part of a month being treated as a full month for the purposes of calculating interest).

 

             In the event that it is necessary to recover any outstanding fees from the client(s), the client(s) will fully reimburse any costs and expenses incurred during the recovery period, including court costs. Eco 360 reserves the right to make a charge for every letter sent and telephone/fax call made in connection with the recovery.

 

             Should any equipment be damaged or lost on site at the fault of the client(s), then Eco 360 withholds the right to charge the client(s) 100% above the current market value for that exact product or the nearest similar product.

 

 

 

1.3      The Report

 

All reports commissioned to Eco 360 will be provided within 10-15 working days from the date of the survey or the date of the final survey visit. A fast-track service is also available whereby Eco 360 commits to providing the report within 4 working days. This will be supplied to the client via an electronic copy, unless otherwise stated.

 

If any part of the report is lost or altered without the written permission of Eco 360, then the entire report becomes invalid.

 

             The reports are certified products and cannot be shown, copied or distributed to third parties without the written permission of Eco 360. No liability is accepted for the contents of the report, other than to that of the client(s).

 

             No reliance should be made on any such comments in relation to the structural integrity of the buildings on site. All information within the report is based only on evidence that has been found on site during the service provided. No individual opinion or inference will be made other than that of the suitably qualified ecologist appointed to the project.

 

1.4      Insurance Cover

 

All work carried out by Eco 360 is covered by professional indemnity insurance.

 

1.5      Quality of Craftsmanship

 

             When appointing an Ecologist, use only suitably qualified and experienced companies (The Local Authority and the Chartered Institute of Ecology and Environmental Managers [CIEEM] may be able to provide a list of such companies). Eco 360 will not accept any liability for works undertaken by any other companies or contractors.
